Frankly Food Terms of Service

1. Acceptance of These Terms
Frankly Food ("Frankly Food," "we," "us," or "our") is a private, invite-only hobby project.
These Terms of Service ("Terms") govern your access to and use of the Frankly Food website, application, and related services (collectively, the "Service").
By creating an account, selecting the checkbox indicating your agreement, submitting an image, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Private, Invite-Only Access
The Service is not offered to the general public. You may use it only if we have authorized your access.
Receiving an invitation or account does not create a right to continued access. We may approve, deny, limit, suspend, or revoke access at any time.
You may not:
- share your account or password;
- allow another person to use your account;
- provide access to anyone under 18;
- sell, sublicense, transfer, or redistribute access;
- publicly advertise access to the Service; or
- create additional accounts without permission.
3. About the Service
Frankly Food is a novelty entertainment application that uses artificial intelligence to review a submitted image and return one of two general results:
- "Hotdog," when the Service determines that the image contains a hot dog in a bun; or
- "Not hotdog," which may include an estimated identification and a humorous or snarky comment.
The Service is inspired by a fictional concept from popular entertainment. Frankly Food is an independent hobby project and is not affiliated with, sponsored by, endorsed by, or associated with any television program, studio, network, streaming service, actor, producer, or rights holder.
4. Entertainment Purposes Only
The Service is provided solely for novelty and entertainment.
Results are generated by artificial intelligence and may be inaccurate, incomplete, inconsistent, misleading, inappropriate, or offensive.
You must not rely on the Service for:
- medical, health, dietary, or allergy advice;
- food-safety determinations;
- identification of a person, animal, substance, or dangerous object;
- legal, financial, security, or emergency decisions; or
- any other decision that could affect someone's health, safety, rights, or property.
The Service cannot determine whether food is safe to eat, whether an item contains allergens, or whether any person or object has been correctly identified.
You are solely responsible for independently evaluating any result before using, sharing, or acting on it.
5. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
By creating an account or using the Service, you represent and warrant that you are at least 18.
The Service is intended for a general adult audience and is not directed to children. We may immediately suspend or delete an account if we reasonably believe its user is under 18.
6. Accounts
You may be required to create an account using a username and password.
You agree to:
- provide accurate account information;
- keep your password confidential;
- prevent unauthorized use of your account;
- refrain from sharing your account; and
- accept responsibility for activity conducted through your account.
We may reject or remove a username that is unlawful, misleading, impersonates another person, infringes someone's rights, or is otherwise inappropriate.
If the Service does not collect your email address, password recovery may not be available. Losing your password may result in permanent loss of access to your account.
7. How Images Are Processed
When you submit an image:
- The image is transmitted from your device to the Frankly Food application;
- the application temporarily processes the image in working memory;
- the image is encoded and transmitted to Anthropic's Claude API;
- Anthropic analyzes the image and returns a response;
- the response is displayed to you; and
- the application discards its temporary working copy after processing is complete.
Frankly Food does not intentionally:
- save submitted images to its application database;
- maintain a gallery or archive of submitted images;
- store individual image-analysis results; or
- maintain a history of your image checks.
Temporary technical copies may exist during transmission and processing. Hosting, security, and AI providers may independently process or retain information according to their own systems, agreements, and policies.
Every submitted image is transmitted to Anthropic. Do not submit an image unless you consent to that transmission and processing.
Anthropic may temporarily retain submissions for service operation, legal compliance, security, or abuse prevention under its applicable terms and data-retention policies. Frankly Food does not control data independently retained by Anthropic.
8. Your Content
"Your Content" means any image or other material you submit through the Service.
You retain any rights you hold in Your Content.
You grant Frankly Food a limited, nonexclusive, worldwide, royalty-free license to receive, transmit, encode, temporarily reproduce, process, and analyze Your Content solely as necessary to operate, secure, and provide the Service.
This license ends when processing is complete, except to the extent continued processing or retention is:
- performed independently by a service provider under its applicable terms;
- required by law; or
- reasonably necessary to investigate fraud, abuse, or a violation of these Terms.
By submitting Your Content, you represent and warrant that:
- you own it or have permission to submit and process it;
- its submission does not violate copyright, privacy, publicity, contractual, or other rights;
- every depicted person has consented to the image's capture and submission;
- it does not depict anyone under 18; and
- it complies with these Terms and applicable law.
9. Prohibited Content
You may not submit an image or other material containing:
- a person under 18;
- nudity, pornography, sexual activity, or sexually suggestive content;
- gore, graphic injuries, graphic violence, or cruelty;
- content intended to harass, threaten, stalk, bully, intimidate, or defame;
- private, confidential, or identifying information used to expose or "dox" someone;
- unlawful discrimination or hateful conduct;
- copyrighted content you do not have permission to use;
- material that violates privacy, publicity, intellectual-property, or contractual rights;
- instructions or material supporting illegal activity;
- malware, malicious code, or harmful files; or
- any other unlawful or seriously disturbing material.
The fact that the Service technically accepts an upload does not mean the upload is permitted.
10. Prohibited Conduct
You may not:
- use bots, automated scripts, scraping tools, or other automated systems;
- submit excessive, repetitive, or coordinated requests;
- interfere with or overload the Service;
- attempt to bypass access controls or safety restrictions;
- attempt to manipulate, "jailbreak," or extract hidden instructions from the AI;
- probe, scan, or test the Service for vulnerabilities without permission;
- reverse engineer or attempt to obtain the Service's source code;
- impersonate another person;
- use the Service for fraud, harassment, surveillance, or unlawful activity;
- access another user's account;
- conceal or misrepresent the source of a submission; or
- use the Service in a manner that violates Anthropic's applicable usage policies.
We may reject submissions, restrict usage, suspend accounts, preserve relevant evidence, or report suspected unlawful conduct when reasonably necessary.
11. AI-Generated Results
Artificial-intelligence outputs are probabilistic. Similar or identical images may receive different results.
A result may:
- incorrectly identify an image;
- omit important information;
- contain an inappropriate or unexpected remark;
- reflect bias or limitations in the AI system; or
- be factually wrong.
Humorous or snarky comments are provided for entertainment. They are not verified statements of fact or judgments about any person.
AI-generated results do not necessarily reflect the views of Frankly Food or Anthropic.
You are responsible for how you use or share a result. You may not represent a result as professionally reviewed, verified, authoritative, or suitable for a serious decision.
12. Information and Privacy
Frankly Food may store:
- your username;
- a securely hashed version of your password;
- your email address, if email collection is later enabled;
- the date, time, and version of the Terms you accepted;
- your most recent activity timestamp, if enabled;
- security and operational records needed to protect the Service; and
- information required by law.
Frankly Food does not intend to store submitted images, individual results, or a history of image checks.
We do not sell personal information or use account information to send third-party marketing messages.
Information may be processed or disclosed:
- to Anthropic when you submit an image;
- to providers that host, secure, maintain, or operate the Service;
- when required by law, legal process, or a valid governmental request;
- to investigate fraud, abuse, security threats, or violations of these Terms;
- to protect the rights, safety, or property of users, the public, or the Service; or
- as part of a transfer or discontinuation of the Service, subject to applicable law.
Providers may include:
- Anthropic, for artificial-intelligence analysis;
- Render, for application hosting; and
- Cloudflare, for DNS, security, content delivery, or traffic proxying.
These providers may receive image content, IP addresses, request timestamps, traffic information, security events, or other technical information as necessary to perform their services.
Frankly Food does not use submitted images to train an AI model. Third-party providers' handling of information is governed by their own terms and policies.
13. Account Deletion
You may delete your account using the account-deletion option within the Service.
After an account is deleted, we will delete or anonymize the associated account information under our control within a reasonable period, except for information retained as necessary to:
- comply with law;
- maintain security records;
- prevent fraud or repeated abuse;
- resolve disputes; or
- enforce these Terms.
Deleting your account does not control information independently retained by Anthropic, Render, Cloudflare, or another provider under its own policies.
14. Intellectual Property
Except for Your Content and third-party materials, the Service—including its software, design, branding, text, graphics, and original content—is owned by Frankly Food or its licensors and is protected by applicable intellectual-property laws.
Permission to use the Service does not give you ownership of the Service or permission to copy, reproduce, distribute, sell, publicly display, reverse engineer, or create derivative works from it.
You may not use the Frankly Food name, branding, visual identity, or content in a manner that suggests endorsement, affiliation, or ownership.
Third-party names, trademarks, entertainment references, and other intellectual property remain the property of their respective owners.
15. Feedback
If you voluntarily provide ideas, suggestions, or feedback, you grant Frankly Food a perpetual, worldwide, nonexclusive, royalty-free right to use that feedback without compensation or obligation to you.
Do not submit confidential information as feedback.
16. Suspension and Termination
We may reject a submission or restrict, suspend, or terminate your account if we reasonably believe that you:
- violated these Terms;
- engaged in unlawful or abusive conduct;
- created security, legal, or operational risk;
- misused a third-party service;
- interfered with the Service; or
- exposed Frankly Food or another person to potential harm.
We may act without advance notice when immediate action is appropriate.
You may stop using the Service and delete your account at any time.
Sections that logically should continue after termination—including intellectual property, disclaimers, liability limitations, indemnification, and governing law—will remain effective.
17. Availability and Changes to the Service
Frankly Food is an experimental hobby project.
We do not promise that the Service will remain available, free, uninterrupted, secure, accurate, or compatible with any particular device.
We may:
- add, remove, or change features;
- impose technical or usage limits;
- temporarily suspend the Service;
- restrict access; or
- permanently discontinue the Service.
Although the Service may generally permit unlimited submissions, we may impose reasonable limits to prevent abuse, preserve availability, or control operating costs.
We are not liable for an outage, modification, loss of access, or discontinuation.
18. Changes to These Terms
We may update these Terms from time to time.
The updated version will display a revised effective date. For material changes, we will provide reasonable notice through the Service or require you to affirmatively accept the revised Terms before continuing to use it.
Your continued use after revised Terms become effective constitutes acceptance where permitted by law.
If you do not agree to an update, you must stop using the Service and delete your account.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and all results are provided "as is" and "as available," without warranties of any kind, express or implied.
Frankly Food disclaims all implied warranties, including merchantability, fitness for a particular purpose, accuracy, title, non-infringement, availability, and security.
We do not warrant that:
- a result will be accurate, appropriate, or reliable;
- the Service will correctly identify a hot dog or any other item;
- the Service will be available, secure, or error-free;
- submissions will never be intercepted or exposed;
- third-party services will remain available; or
- defects will be corrected.
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
20. Limitation of Liability
To the maximum extent permitted by law, Frankly Food and its operator, contributors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, privacy, profits, revenue, goodwill, or use arising from or related to the Service.
To the maximum extent permitted by law, the total liability arising from or relating to the Service will not exceed the greater of:
- the amount you paid to use the Service during the 12 months before the event giving rise to the claim; or
- $100.
These limitations apply regardless of the legal theory asserted and even if the possibility of damages was known.
Nothing in these Terms limits liability that cannot lawfully be excluded or limited.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Frankly Food and its operator, contributors, service providers, and representatives from claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:
- Your Content;
- your use or misuse of the Service;
- your violation of these Terms;
- your violation of applicable law; or
- your violation of another person's rights.
22. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceeding arising from or relating to these Terms or the Service must be brought in a court of competent jurisdiction in Texas. Each party consents to jurisdiction in Texas to the extent permitted by law.
23. General Provisions
Entire agreement. These Terms constitute the entire agreement concerning your use of the Service.
Severability. If a provision is found unenforceable, it will be modified only as much as necessary to make it enforceable or severed if modification is not possible. The remaining provisions will remain effective.
No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment. You may not transfer your rights or obligations under these Terms without permission. Frankly Food may assign these Terms in connection with a transfer, reorganization, or discontinuation of the Service.
No third-party beneficiaries. These Terms do not create enforceable rights for any third party.
Headings. Section headings are for convenience and do not affect interpretation.
Electronic acceptance. Selecting the acceptance checkbox or otherwise affirmatively agreeing electronically has the same effect as signing a written agreement.
24. Requests and Reports
Where available, account requests, privacy requests, and reports of misuse may be submitted through the request or reporting feature within the Service.
No continued support, response time, or dispute-resolution service is guaranteed.
